General Terms and Conditions (GTC)
**1. Scope & Contracting Parties**
1.1 These General Terms and Conditions (GTC) apply to all contracts for the temporary provision of apartments and flats for accommodation concluded between Homes Operations GmbH (hereinafter "Homes") and third parties (hereinafter "Guest"). They also apply to all related services and deliveries provided by Homes.
1.2 The guest's contractual partner is Homes Operations GmbH. Any differing terms and conditions of the guest shall only apply if expressly agreed to in writing beforehand.
**2. Reservations/Booking**
2.1 By making a reservation/booking, the guest offers to conclude an accommodation contract. If the booked apartment is available, the guest will receive a reservation/booking confirmation from Homes. The contract between Homes and the guest is concluded upon receipt of this confirmation.
2.2 Homes' offers regarding available apartments are subject to change and non-binding. Homes reserves the right to refuse to conclude an accommodation contract at its own discretion.
**3. Cancellation deadlines/Guest withdrawal/Non-utilization of services**
3.1 A reservation is only guaranteed upon payment by the guest to Homes. The guest can cancel the reservation free of charge within the specified cancellation policy and deadlines, quoting the reservation number.
Unless a right of withdrawal has been agreed upon or the free cancellation period has expired, and Homes does not agree to a cancellation of the contract, Homes retains the right to the agreed-upon compensation. In this case, the guest remains obligated to pay 100% of the agreed-upon accommodation price. In the event of a no-show, the reservation for all subsequent nights will be cancelled from the first night onwards, without any entitlement to the remaining nights.
3.2 For bookings on the day of arrival, payment must be made immediately in accordance with §5, usually within one hour.
**4. Prices, Payment Terms & Invoices**
4.1 The prices displayed at the time of contract conclusion apply. All prices quoted are gross prices and include statutory taxes, fees, and charges. Locally levied charges (e.g., tourist tax) are not included in the price.
4.2 The accommodation price must always be paid in advance by the guest.
4.3 A set-off by the guest is only permissible if the counterclaim is undisputed or has been legally established.
4.4 The accepted payment method is bank transfer. Cash payments are not accepted.
4.5 By booking, the guest agrees to receive the invoice by email.
**5. Possible uses of the reserved apartments**
5.1 The reserved apartment is available to the guest for the booked period.
5.2 The keys, parking permits and/or key cards provided by Homes must be returned to Homes, a third party authorized by Homes, or to the designated drop-off point in the apartment on the day of departure. A fee of €100.00 will be charged for loss or failure to return them. Homes reserves the right to claim further damages if the actual damage exceeds €100.00 (e.g., replacement of the locking system).
5.3 A later check-out (late check-out) can be arranged upon prior agreement and subject to availability. If no such agreement is made, the guest owes the full accommodation price as well as any further damages incurred.
5.4 There is no entitlement to a late check-out.
5.5 Early check-in is also possible subject to availability and prior arrangement. There is no contractual entitlement to this.
**6. Transfer, Subletting & Use**
6.1 Subletting or brokering the apartment is prohibited, in particular transferring it to third parties at prices higher than those quoted by Homes. Assigning or selling claims against Homes is also prohibited.
6.2 The use of the apartment for purposes other than accommodation is prohibited. This includes, in particular, commercial or illegal uses. Using the apartment for photography or video recording is also prohibited without express permission. In case of violation, Homes reserves the right to cancel the booking without refund.
**7. Liability of Homes**
7.1 Homes is liable without limitation for damages to life, body, or health caused by its own negligence. For other damages, Homes is only liable in cases of intentional or grossly negligent breach of duty. In cases of simple negligence, Homes is only liable for breaches of essential contractual obligations that are necessary for the proper performance of the contract.
7.2 In the event of disruptions or defects, Homes will endeavor to rectify them upon notification by the guest. The guest is obligated to contribute to mitigating damages and to inform Homes of any potentially significant damages.
